Binding Agreement Sec. 01

This document is a Master Service Agreement between you ("User") and GratisVPS.net ("Provider"). Accessing our infrastructure constitutes absolute acceptance of these terms. If you represent a legal entity, you warrant that you have the authority to bind that entity to these Terms.

1. Service Nature: "As-Is" Beta

GratisVPS.net provides testing and development environments. We reserve the right to modify, suspend, or terminate any aspect of the service, including the free tier, at any time without liability or notice. High-availability is not guaranteed for the free tier.

2. Mandatory Age Requirement

You must be at least 13 years of age (or the minimum legal age in your country) to use this service. Use by minors is strictly prohibited and results in immediate account deletion.

Acceptable Use Policy (AUP) Zero Tolerance

Our network is monitored 24/7. Use of our servers for any of the following activities will result in Instant Permanent Ban and forfeiture of all data.

3. Virtual Credit Disclaimer

Accounts may display a balance (e.g., $300.00). This is a Non-Monetary Virtual Token used only for interface testing. This balance has zero cash value, is not a debt owed to the user, and cannot be withdrawn, transferred, or refunded under any circumstances.

4. Data Persistence & Backups

WE DO NOT BACK UP YOUR DATA. The User maintains 100% responsibility for data redundancy. We are not liable for data loss due to hardware failure, software bugs, or administrative termination.

5. DISCLAIMER OF ALL WARRANTIES

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRATISVPS.NET DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR UNINTERRUPTED.

6. AGGREGATE LIABILITY LIMITATION

IN NO EVENT SHALL GRATISVPS.NET, ITS OWNERS, OR OPERATORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO $0.00 USD.

7. Indemnification

You agree to indemnify and hold harmless GratisVPS.net from any claims, losses, or legal fees resulting from your use of the server or any content you host on our network.

8. Governing Law & Arbitration

These terms are governed by the laws of Seychelles. Any dispute arising from these terms shall be resolved through final and binding arbitration, rather than in court. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

Severability & Termination Final

If any part of these Terms is found unenforceable, the remaining parts remain in full effect. We reserve the right to terminate any account for any reason, with or without notice, especially in cases of resource abuse or AUP violations.
